1. General provisions.
1.1. These terms for the purchase and sale of services (the “Terms”) are a legally binding document setting out the rights and obligations of the Buyer and Seller, the conditions for purchasing and paying for services, the parties’ liability and other provisions relating to the purchase and sale of services in the online store ginkluklubas.lt.
1.2. By placing an order, the Buyer confirms agreement with these Terms.
1.3. The contract between the Buyer and Seller is considered concluded when the Buyer, after adding items to the basket, providing an email address, selecting a payment method and reading the Terms, clicks the “Buy” button.
2. Protection of personal data.
2.1. When ordering services from ginkluklubas.lt, the Buyer must provide the information requested during purchase: first name, surname, address and email address.
2.2. The Buyer is responsible for providing correct information.
2.3. By placing an order, the Buyer agrees that the personal data provided may be processed to fulfil the order. The Buyer also agrees to receive information necessary for delivery of the gift voucher at the email address provided.
2.4. The Buyer’s personal data may be processed for marketing purposes only with the Buyer’s express consent.
2.5. The Seller undertakes not to disclose the Buyer’s personal data to third parties, except where required by a competent state authority in cases provided for by Lithuanian law, or with the Buyer’s separate written consent.
3. Buyer’s rights and obligations.
3.1. The Buyer undertakes to pay the Seller the agreed amount for the services ordered.
3.2. The Buyer must provide complete, detailed and accurate information in the checkout form. If the Buyer provides inaccurate, false or misleading information, Ginklų klubas may cancel the Buyer’s registration and delete the data.
3.3. The Buyer must promptly inform the Seller of any changes to the information provided in the purchase form.
3.4. The Buyer may withdraw from the service purchase contract in accordance with the provisions of the Refund Rules.
3.5. By placing an order at ginkluklubas.lt, the Buyer agrees to these Terms and undertakes to comply with them and applicable Lithuanian legislation.
4. Seller’s rights and obligations.
4.1. The Seller undertakes to provide the conditions necessary for the Buyer to use the online store’s services properly.
4.2. If the Buyer attempts to compromise the online store’s stability or security, or breaches their obligations, the Seller may immediately restrict, suspend or terminate the Buyer’s access without notice.
4.3. The Seller undertakes to respect the Buyer’s privacy in relation to personal information provided in the purchase form and not to transfer it to third parties.
4.4. The Seller undertakes to deliver the gift voucher to the email address provided by the Buyer.
4.5. In significant circumstances, the Seller may temporarily or permanently discontinue the online store’s operations without prior notice to the Buyer.
4.6. The Seller may unilaterally amend these Terms.
4.7. Use of ginkluklubas.lt services following such amendments is considered acceptance of the amended Terms.
5. Orders, prices, payment procedure and time limits.
5.1. The Buyer may purchase online 24 hours a day, seven days a week.
5.2. Orders are accepted only through the online store ginkluklubas.lt.
5.3. Payments may be made through the online banking services of Swedbank, SEB, Luminor, Citadele and Šiaulių bankas. Payments are accepted in euros and processed through the MakeCommerce.lt payment platform.
6. Confirmation of a service purchase.
6.1. The Seller is not liable for failure to meet gift voucher delivery deadlines where the voucher is not delivered, or is delivered late, because the Buyer entered an incorrect email address or because of circumstances beyond the Seller’s control.
6.5. The Buyer must promptly inform the Seller if the gift voucher has not arrived by email.
7. Service quality and guarantees.
7.1. All service packages sold in the online store are specified in the description accompanying each service.
7.2. The Seller sets validity periods and conditions for individual service packages.
8. Marketing and information.
8.1. The Seller may organise promotions and offers in the online store.
8.2. The Seller may unilaterally change or cancel promotional conditions without separate notice. Changes or cancellations take effect from the time they are made.
8.3. The Seller sends notifications to the email address provided in the Buyer’s purchase form.
8.4. The Buyer sends all notifications and questions using the contact details in the online store’s Contacts section.
8.5. The Seller is not liable if the Buyer does not receive information or confirmation messages because of internet or email service disruptions, messages being placed in a spam folder, or incorrect details provided by the Buyer.
8.6. The Buyer’s personal data may be processed for marketing purposes under the conditions in clause 2.4.
9. Final provisions.
9.1. These purchase and sale Terms have been drawn up in accordance with Lithuanian laws and regulations.
9.2. Lithuanian law applies. Any disagreements arising from the implementation of these Terms are to be resolved through negotiation. If no agreement is reached, disputes are resolved in accordance with Lithuanian law.
